When it comes to recruiting domestic employees in the UAE, various legal procedures have raised questions in the public's mind. A man from India asked us what legal steps should be taken because he wants to bring a full-time maid from his homeland to live with them.

His questions have led us to believe that he is married and living in Dubai with his family. Furthermore, it is presumed that the domestic worker he plans to hire from India already holds an ECR (Emigration Check Required) passport. For the employment of domestic workers in the UAE, Federal Decree Law No. 9 of 2022 Concerning Domestic Workers (the "UAE Domestic Workers Law") is applicable.

On December 5, 2022, the UAE Domestic Workers Law came into effect. The law's Article 11 outlines the duties of employers, including providing suitable housing, workspaces, meals, and clothing necessary for performing tasks, paying wages on time, covering medical expenditures, showing workers respect and decency, incurring repatriation fees, etc.

You must register with the Government of India's E-Migrant Web Portal (www.emigrate.gov.in), enter the details in the application, and submit. You can then visit IVS Global Services (the "IVS"), a third-party service provider, to attest papers after they have been approved by the Indian Embassy in the UAE and the Consulate General of India - Dubai.

You, in the position of the sponsor of the proposed domestic worker’s employment visa, are required to sign an affidavit at the IVS center stating that you are not related to the intended domestic worker. This document will then be attested by a representative of the Consulate General of India - Dubai. After these steps have been completed, you must apply for the proposed domestic worker's employment visa (entry permit) with the Ministry of Human Resources and Emiratization (the "MOHRE").

A copy of your marriage certificate duly attested in India as well as the UAE

A tenancy contract and Ejari of the rented apartment (at least two bedrooms) or a copy of the title deed to your residential property, which is owned by you (at least two bedrooms),

A copy of your bank statement

A copy of your employment contract and salary certificate issued by your employer

After receiving the entry permit from the General Directorate of Residency and Foreigners Affairs in Dubai (the "GDRFA") and the offer letter in a format that has been approved by the MOHRE, you must submit all necessary paperwork to IVS in addition to the refundable deposit demanded by the Consulate General of India in Dubai.

After IVS has attested the domestic worker's entry permit, an agreement will be prepared through E-Migrant and emailed to the prospective domestic worker. In order to obtain emigration approvals for the suggested domestic worker to travel to the UAE, the agreement along with an attested entry permit will then be sent to the Protector of Emigrants (POE), India.

The entry permit provided by GDRFA will allow your proposed domestic worker to enter the UAE once the aforementioned steps have been completed. Within two weeks of the worker's arrival, you might then need to go with them to the Consulate General of India - Dubai for an entry interview.

You should move forward with signing the MOHRE employment contract. The proposed domestic worker must also pass a medical fitness test, and you must apply for both an Emirates ID and health insurance for him or her.
